In the days that followed the inaguaration we have seen executive orders that have been directly targeting our community. Below is information to help understand where these orders currently stand.
We wanted to give some information on this tool that is being used to hurt and attack our community and give a list of some of the orders that are directly affecting out community.
An Executive Order is a written directive that is signed by the acting president that gives orders to the government on how to take action.
An executive order does not override federal laws and statues. It is also not a statue or law. It is a declaration on how to implement a law or statute.
The time line on when an executive order takes effect is not set, as some can go into effect as soon as an order is signed whereas others may take days, weeks or even years. Some may have a deadline while others may not.
There may be checks and balances to stop harmful orders. A future president can amend or rescind an early order. Congress can enact a law that reverses an order. And a court can hold that an order violates the Constitution or federal law.
·Eliminates the idea of gender identity and replaces it with biological sex, which is determined at birth and cannot change.
·The only two sexes are male and female.
·Requires all federal government issued I.D.’s and records to include only biological sex, including personnel records for government employees.
·Applications for new and renewed passports who use an “X” marker or for transgender people who have updated their gender markers will be rejected or changed to the biological sex determined at birth. IT IS RECOMMENDED THAT THOSE HOLDING CURRENT PASSPORTS NOT RENEW THEM UNTIL THEY ABSOLUTELY HAVE TO.
CURRENT PASSPORTS ARE BEING HONORED.
·Ignore the transgender rulings of the Supreme Court case in 2020 that established the federal anti-discrimination laws under Title VII (expect lots of litigation over this one!)
·Orders Federal Bureau of Prisons to house inmates solely based on biological sex.
·Bars federal funds for gender confirmation surgery or procedures in any federal prison.
·Directs Department of Housing and Urban Development to bar transgender women from women-only spaces under its regulations.
WHEN: These will be implemented between now and July 2025. It is difficult to say when each individual piece will go into effect within that time frame.
·Trump rescinded President Biden’s order stating that all transgender people who wish to serve in the military and meet appropriate standards shall be able to serve open and free of discrimination. This is now no longer in effect. This will allow the Pentagon and other military agencies to adopt new regulations to bar transgender people from service (both new and existing service members) and bar transgender healthcare in the military.
WHEN: These will be implemented between now and July 2025. It is difficult to say when each individual piece will go into effect within that time frame.
·Seeks to limit access to necessary medical care for transgender young people.
·Directs agencies to implement policies that would ban federal funding for such care.
·These policies directly impact those with federal employee health insurance, Medicare and Medicaid.
·Restricts federal research and education funding to academic institutions that provide such care. THIS IS PARTICULARLY WORRYING, AS IT CAN STOP FEDERAL GRANTS TO MOST UNIVERSITIES AND HOSPITALS IF THEY PROVIDE TRANSGENDER CARE FOR YOUNG PEOPLE, EVEN IF THOSE FEDERAL GRANTS ARE NOT USED FOR THAT PARTICULAR PURPOSE.

·This is a sweeping order that takes aim at inclusion efforts in schools that support transgender, non-binary, gay, lesbian, bisexual and youth of color.
·Directs the Department of Education to incorporate policies that would threaten school’s ability to provide education about race and gender.
·Could jeopardize funding for schools if they refuse to censor curriculum about United States history, families and the diversity of our country or recognize transgender or non-binary students.
